Executive Summary:

  • Amendement 138, and the Telecoms Package:

In May, Parliament did not adopt the conciliation agreement reached in Council on Amendment 138. This disagreement gives rise to a conciliation procedure and 27 MEPs have been chosen (you can find the list of selected MEPs here) and 27 representatives of Member States.   Of these 54 people, 6 will make up a negotiating team, and they will have 6 to 8 weeks to find a compromise.
This will later have to be approved by Parliament and the Council.

The negotiating team began its work, and the two persons in charge of the negotiations are

- Catherine Trautmann
- Alejo Vidal Quadras

and they are both very open to find an agreement with the Council, by allowing Internet restrcitions on users following a judiciary request.  They are currently under a lot of pressure from other MEPs and lobbyist in order to maintain the amendment 138 as it is, therefore making forced restriction of the Internet unconstitutional.

We should have information mid-to-late November, for approval by Parliament in December.
If no conciliation is reached, the Telecoms Package will be declared invalid.

  • About the measures taken to fight piracy:

Each European country is in the process of fighting pirates, with the cooperation of Internet Services Providers.
The French National Assembly has approved the Hadopi "Three strike rule" also currently being studied in most other European countries.

Finland recently recognized the Internet as a fundamental right, and is therefore studying the three strike rule without the consequence of cutting the Internet access of the user.
Estonia was the first European country to recognize the internet as a fundamental right (2004).
